Impacto de la política criminal en la prevención del delito de extorsión en el distrito fiscal de Lima Norte, 2023

Abstract

La presente investigación titulada “Impacto de la política criminal en la prevención del delito de extorsión en el Distrito Fiscal de Lima Norte, 2023”; tiene como finalidad determinar si la política criminal es eficaz para prevenir el delito de extorsión en el Distrito Fiscal de Lima Norte. Se desarrolló una investigación de tipo básica con un enfoque cualitativo a nivel descriptivo, teniendo el diseño de teoría fundamentada. Para ello, se aplicaron entrevistas a 06 participantes especialistas en derecho penal. Los resultados revelan que existen deficiencias en las estrategias implementadas por el Estado debido a que no se ha adaptado a los avances personales y tecnológicos de la sociedad para identificar a los partícipes del hecho ilícito; además, se resalta que la ineficacia se debe a la falta de comunicación de las entidades públicas encargadas de administrar justicia. Se concluye que los expertos sostienen que las medidas actuales son insuficientes y el Estado debe enfocarse en acciones estratégicas, avances personales y tecnológicos, comunicación efectiva entre la Policía y el Ministerio Público y una fuerza laboral permanente.

The present research entitled “Impact of criminal policy in the prevention of the crime of extortion in the Fiscal District of Lima Norte, 2023”; aims to determine whether criminal policy is effective in preventing the crime of extortion in the Fiscal District of Lima Norte. A basic type of research was developed with a qualitative approach at a descriptive level, having the design of grounded theory. For this, interviews were applied to 06 participants who are specialists in criminal law. The results reveal that there are deficiencies in the strategies implemented by the State because it has not adapted to the personal and technological advances of society to identify the participants in the illicit act; In addition, it is highlighted that the ineffectiveness is due to the lack of communication of the public entities in charge of administering justice. It is concluded that the experts maintain that the current measures are insufficient and the State must focus on strategic actions, personal and technological advances, effective communication between the Police and the Public Ministry and a permanent workforce.
