El derecho a guardar silencio del acusado en juzgamiento contrastado en las sentencias penales condenatorias en el distrito jurisdiccional de Ica - 2021

Abstract

La presente investigación titulada “El derecho a guardar silencio del acusado en juzgamiento contrastado en las sentencias penales condenatorias en el distrito jurisdiccional de Ica – 2021” tuvo como objetivo general: Determinar la influencia del derecho a guardar silencio del acusado en juzgamiento en la motivación de las sentencias penales condenatorias, en el distrito jurisdiccional de Ica-2021; se aplicó como metodología La presente investigación se considera básica, posee un enfoque netamente cuantitativo, no experimental, descriptivo- explicativo; la población se conformó por 21 sujetos especialistas en la materia a los cuales se les aplico un cuestionario de tipo dicotómico; se obtuvo como resultado que el derecho a guardar silencio influye en el juzgamiento en contratación de la motivación de las sentencias penales condenatorias, en el distrito jurisdiccional de Ica-2021; así mismo mediante el mismo estadístico, se establece que la influencia (asociación lineal ) de una variable sobre la otra tuvo un valor de 2,532.The present investigation entitled "The right to remain silent of the defendant in proven judgment in criminal sentences in the jurisdictional district of Ica - 2021" had as a general objective: To determine the influence of the right to remain silent of the defendant in trial on the motivation of criminal convictions, in the jurisdictional district of Ica-2021; it was applied as a methodology. This research is considered basic, it has a purely quantitative, non-experimental, descriptiveexplanatory approach; the population was made up of 21 subject specialists in the matter to whom a dichotomous questionnaire was applied; It was obtained as a result that the right to remain silent influences the judgment in contracting the motivation of the criminal sentences, in the jurisdictional district of Ica-2021; Likewise, using the same statistic, it is established that the influence (linear association) of one variable on the other had a value of 2,532.
